Creator Partnership Terms

These Creator Partnership Terms govern participation in the Conchords Apparel creator program. By submitting designs or joining the platform as a creator, you agree to the terms outlined below.

1. Overview

Conchords Apparel partners with independent creators to produce and sell merchandise featuring their designs. Conchords Apparel provides the infrastructure required to bring creator merchandise to market, including product production, storefront hosting, fulfillment, and customer service.

Creators remain independent and retain ownership of their artwork while granting Conchords Apparel permission to produce and sell merchandise featuring their designs.

2. Creator Eligibility

Creators may apply to join the platform by submitting an application through the Conchords Apparel website. Acceptance into the program is at the sole discretion of Conchords Apparel.

Conchords Apparel reserves the right to approve or decline creator applications or submitted designs that do not meet platform standards.

3. Creator Responsibilities

Creators are responsible for:

• Submitting original artwork they have the legal right to use
• Promoting their merchandise when participating in promotion tiers requiring creator promotion
• Ensuring their designs do not violate copyright, trademark, or intellectual property laws
• Following all platform policies and guidelines

Creators may not submit designs that contain copyrighted material, offensive content, or unlawful imagery.

4. Intellectual Property Ownership

Creators retain full ownership of their artwork and intellectual property.

By submitting designs to Conchords Apparel, creators grant Conchords Apparel a non-exclusive license to produce, display, market, and sell merchandise featuring the submitted designs for the duration of the creator partnership.

Creators may remove their designs from the platform with written notice, subject to completion of any pending orders.

5. Production and Fulfillment

All merchandise sold through the platform is produced and fulfilled through Conchords Apparel and its production partners.

Conchords Apparel is responsible for:

• Product manufacturing
• Order fulfillment
• Shipping logistics
• Customer support related to orders

Production times may vary depending on product type and demand.

6. Apparel Branding

All garments produced through the platform may include Conchords Apparel branding or labeling on the garment tag or interior label.

This labeling identifies the product as being produced through the Conchords Apparel platform.

7. Creator Revenue Model

Creators earn a percentage of profits based on the promotion tier selected when joining the platform.

Promotion tiers determine the revenue share applied to all sales of the creator’s merchandise.

Creator Promotion Tier

Creators who actively promote their merchandise may earn a higher share of profits.

Shared Promotion Tier

Both the creator and Conchords Apparel may promote the merchandise.

Platform Promotion Tier

Conchords Apparel may promote the merchandise through platform marketing, advertisements, or featured store placement.

The selected promotion tier applies to all sales unless otherwise agreed upon in writing.

8. Earnings and Payouts

Creator earnings are calculated based on profits generated from merchandise sales.

Payouts are issued on a monthly basis once the creator’s balance reaches the minimum payout threshold established by Conchords Apparel.

Creators will receive access to sales reporting or revenue summaries when applicable.

9. Taxes

Creators are responsible for reporting and paying any taxes related to earnings received through the platform.

Where legally required, Conchords Apparel may issue tax documentation such as 1099 forms for qualifying creators.

10. Returns and Refunds

Returns and refunds are handled in accordance with the Conchords Apparel Return & Refund Policy.

Refunds may occur due to manufacturing defects, damaged items, or fulfillment issues.

Creators are not responsible for customer service issues related to order fulfillment.

11. Platform Standards

Conchords Apparel reserves the right to remove designs or merchandise from the platform if they:

• Violate intellectual property laws
• Contain offensive or harmful content
• Conflict with platform standards or brand guidelines

Creators will be notified if their designs are removed from the platform.

12. Modification of Terms

Conchords Apparel reserves the right to modify or update these terms as the platform evolves.

Updated terms will be published on the website and apply to continued participation in the creator program.

13. Termination of Partnership

Either party may terminate the creator partnership at any time.

Upon termination:

• Existing orders will be fulfilled
• Merchandise listings may be removed from the platform
• Creator payouts will be processed according to the payout policy

14. Limitation of Liability

Conchords Apparel is not responsible for indirect losses, lost profits, or damages arising from creator participation in the platform beyond the earnings generated through merchandise sales.
